The biggest US crypto bill in years is about to move
The Senate Banking Committee is preparing a vote on the Digital Asset Market Clarity Act — the House-passed bill that finally draws a line between SEC and CFTC jurisdiction for digital assets. Under the framework, the SEC keeps securities, the CFTC takes digital commodities, and most large-cap tokens — Bitcoin, Ethereum, and the deeply decentralized L1s — land under the more trader-friendly CFTC regime.
The stakes are larger than they look. Years of regulation-by-enforcement under the prior SEC effectively shut new token listings out of US venues and kept institutional capital on the bench. A clean jurisdictional split unwinds that. Coinbase, Kraken, and the prime desks that have been parked since 2022 get the rulebook they've been waiting on.
What the bill actually does
Three pieces matter for traders:
- Mature Blockchain Test. A token counts as a digital commodity — and falls under CFTC — once the underlying network is sufficiently decentralized. That pulls ETH out of the SEC gray zone and, in all likelihood, does the same for SOL.
- Spot custody clarity. Brokers and custodians can hold and trade spot crypto without colliding with overlapping SEC/CFTC rules.
- DeFi carve-out. Non-custodial protocols are explicitly not brokers — a meaningful win for onchain liquidity.
What to watch
Markets have already started to position. Bitcoin is holding the low-$80,000s, and XRP printed roughly a 4% gain into the start of the week. The vote itself matters less than the margin. A tight committee tally telegraphs trouble on the Senate floor. A clean bipartisan number is the trigger for a broader re-pricing in the regulatory-sensitive names — XRP, SOL, and ADA first.
The risk sits on the back half. Even with committee passage, the bill still needs a floor vote in the full Senate, and the calendar between now and the summer recess is tight. Headlines will run faster than legislation does. Size positions accordingly and wait for the first real confirmation tape rather than trading every Politico leak.
